1. About Nearfo

Nearfo ("we," "us," "our") is a hyperlocal social discovery platform operated from Amravati, Maharashtra, India. Nearfo enables users to connect with people in their local area through a unique algorithm that prioritizes 80% local content and 20% global content within a 200-kilometer radius.

2. Eligibility

To use Nearfo, you must:

• Be at least 13 years of age (or the minimum legal age in your jurisdiction)
• If you are between 13 and 18 years old, have parental or guardian consent to use the App
• Have the legal capacity to enter into a binding agreement
• Not be a person barred from using the App under Indian law or any other applicable jurisdiction

3. Account Registration

When you create an account on Nearfo, you agree to:

• Provide accurate, current, and complete information during registration (via Google Sign-In or Phone OTP)
• Maintain and update your information to keep it accurate
• Keep your account credentials secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. User Content

4.1 Your Content

You retain ownership of all content you post, upload, or share on Nearfo ("User Content"). By posting User Content, you grant Nearfo a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, modify, and distribute your User Content solely for the purpose of operating and improving the App.

4.2 Content Standards

You agree that your User Content will not:

• Contain hate speech, threats, harassment, bullying, or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
• Include sexually explicit, obscene, or pornographic material
• Promote violence, terrorism, or illegal activities
• Infringe upon the intellectual property rights, privacy, or other rights of any third party
• Contain spam, phishing attempts, malware, or deceptive content
• Impersonate any person or entity or misrepresent your affiliation
• Contain false, misleading, or defamatory information

4.3 Content Moderation

Nearfo reserves the right to review, moderate, and remove any User Content that violates these Terms or our community guidelines, at our sole discretion and without prior notice. We use both automated systems and human review to maintain content quality.

5. Location Services

Nearfo's core functionality relies on location data. By using the App, you acknowledge and agree that:

• The App requires access to your device's location services to provide its hyperlocal features
• Your approximate location may be visible to other users within the discovery radius (up to 200km)
• Your precise GPS coordinates are never shared publicly — only your city/area-level location is displayed
• You may disable location services at any time through your device settings, though this will limit App functionality

6. Prohibited Activities

While using Nearfo, you agree not to:

• Use the App for any unlawful purpose or in violation of any local, state, national, or international law
• Collect or harvest personal data of other users without their express consent
• Use automated scripts, bots, or scrapers to access or interact with the App
• Interfere with or disrupt the App's servers, networks, or security features
• Attempt to gain unauthorized access to other user accounts or App systems
• Create multiple accounts for deceptive or abusive purposes
• Use the App to advertise or sell products/services without our prior written consent
• Reverse-engineer, decompile, or attempt to extract the source code of the App

7. Intellectual Property

The Nearfo name, logo, brand elements, UI design, algorithm, and all associated intellectual property are owned by Nearfo and its creator. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our express written permission.

8. Third-Party Services

Nearfo integrates with third-party services including but not limited to:

• Google Firebase (Authentication, Cloud Messaging)
• Amazon Web Services (Cloud Infrastructure, Storage)
• Google AdMob (Advertising)

Your use of these third-party services is subject to their respective terms and privacy policies. Nearfo is not responsible for the practices of these third-party providers.

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause or notice, if we believe you have violated these Terms. You may also delete your account at any time through the App settings. Upon termination:

• Your right to use the App ceases immediately
• We may retain certain data as required by law or legitimate business purposes
• Content you have shared may persist in the accounts of users who have saved or interacted with it

10. Disclaimers

Nearfo is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding the App's reliability, availability, accuracy, or fitness for a particular purpose. We do not guarantee that:

• The App will be available at all times without interruption
• The App will be free from errors, bugs, or security vulnerabilities
• Any content posted by users is accurate, complete, or reliable
• Connections made through the App will be safe or beneficial

11. Limitation of Liability

To the maximum extent permitted by applicable law, Nearfo and its founder, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the App.

12. Indemnification

You agree to indemnify, defend, and hold harmless Nearfo, its founder, employees, and affiliates from any and all claims, damages, obligations, losses, liabilities, costs, or expenses arising from your use of the App, your User Content, or your violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Amravati, Maharashtra, India.

14. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you through the App or via email. Your continued use of the App after such notification constitutes acceptance of the revised Terms.
